Frequently Asked Questions

The LMIA process prioritizes job opportunities in Canada for Canadian citizens and permanent residents.

To qualify to apply for the high-wage LMIA, employers must first advertise their job posting for four continuous weeks in a minimum of three different places. The low-wage LMIA requirements include advertising in at least three sources.

A foreign worker can obtain a 24-36 month permit to work in Canada with a valid LMIA.

Before applying for an LMIA, employers must show they made fair efforts to hire Canadian citizens or permanent residents to fill the job vacancy.

The LMIA application must contain details about the employer, the position offered, the salary, and the steps taken to first hire Canadian citizens or permanent residents.

It is essential to stay updated and refer to official sources for the most current LMIA rules and regulations since they are subject to change periodically.

One common issue employers encounter is the upfront cost. However, the benefits of hiring a foreign worker outweigh the cost.

Temporary workers are restricted in their mobility because their work permit is specific to their employer. Since their salaries are fixed during the contract period and do not increase over time, working for additional income is not possible. Therefore, the employer’s labour costs are fixed, and there is little risk of the employee quitting for higher pay elsewhere.

The Government of Canada requires employers to obtain a valid LMIA before hiring a foreign worker. The second step in this process is obtaining a work permit.
